How It Works
Lake Whillans provides non-recourse financing for the purpose of warehousing legal risk. In the context of these litigations, Lake Whillans will either (i) purchase the entirety of a company’s interest in the litigations, (ii) structure an investment whereby a portion of a company’s interest is monetized, but where up-side is retained, or (iii) finance the litigation fees and expenses associated with an opt-out action.
Our offerings enable your company to receive payment today rather than waiting to receive an uncertain amount on an uncertain date in the future.
The Process
- Based on an estimate of your company’s drug purchasing history, we can quickly provide an amount we would be willing to pay for your claim portfolio.
- If you and Lake Whillans are mutually interested in pursuing a transaction based on that estimate, we will enter a non-disclosure agreement and request more specific information to substantiate these purchases.
- Lake Whillans will then make a firm proposal to purchase some or all of your company’s claim entitlements.
- If you accept the offer, we document and execute the transaction.
